Preamble

The site snapclimbing.com, and all rights pertaining thereto, is fully owned by SNAP. Partial or whole reproduction is always subject to the owners' permission. However, hypertext links to the site are permitted without the need for specific request.


1. Acceptance of terms

At the time of ordering, the customer acknowledges the special conditions of sale stated on this screen and expressly accepts them without reservation. 
These terms and conditions govern the contractual relationship between SNAP and their customer and are accepted by both parties without reservation. These terms and conditions shall prevail over all other conditions contained in any document, unless prior written consent has been given.


2. Products

The photographs illustrating the products are not covered by the contract. If errors occur, then at no time can SNAP be held liable. The majority of products offered by SNAP to its customers is available in our warehouse.


3. Order

The automatic registration systems are considered proof of the nature, content and date of the order. SNAP confirms order acknowledgement to the customer at the email address supplied. The sale will be concluded only after the confirmation of the order. SNAP reserves the right to cancel any order from a customer with whom there is a dispute over the payment of a previous order. The information provided by the buyer when placing an order is binding; in the case of an error in the recipient's contact details, the seller cannot be held responsible for any failure to deliver the product.


4. Delivery

After order confirmation, SNAP agrees to deliver to its carrier all items ordered by the buyer within a maximum period of 48 working hours. The carrier undertakes by contract with SNAP to deliver the order to the buyer's address provided by SNAP. In the event of a product in “cash on delivery” transport, the customer agrees to pay the carrier or their agent the full amount specified in the order confirmation. 
In addition, for deliveries outside metropolitan EUROPE, the customer agrees to pay all taxes due on importation of goods, customs duty, value added tax and other taxes due under the laws of the country of receipt of order. All orders sent to SSNAP are for the personal use of customers; any resale of the products by customers or recipients, whether partial or total, is strictly forbidden. SNAP is not legally liable in the case of failure to pay taxes by the customer. 
Delivery is handled by La Poste (French postal service) using their Colissimo suivi service (express delivery with tracking). Delivery is handled according to the time frame given by La Poste. In the event of absence, La Poste will redeliver the parcel. Any delays do not entitle the buyer to claim damages. 
Deliveries to EU countries are handled by Mondial Relay for deliveries in EU. 
For technical products, the customer must ensure that the delivered device works properly and must read the instruction manual supplied with the device. 
In case of defects, the buyer has the right to return the item according to the conditions provided in this document. 
Cases of force majeure releasing the seller from his obligation to deliver include: war, civil unrest, fire, strikes, accidents and the impossibility of obtaining supplies. Goods are always transported at the recipient's risk. Always check your parcel on arrival. You have 48 hours to file a claim with the carrier in case of missing or damaged goods. 
Depending on availability, an order can be delivered to the customer in partial shipments. The customer will only pay for one shipment. If the customer requires 2 places of delivery, he must place 2 orders, with the subsequent delivery charges for 2 orders.


5. Cooling off period

You have 7 days (from receipt of the items) to form an opinion. In the event of exchange or refund, return the article(s), new, in their original packaging, intact, along with any accessories, instruction manuals and documents to the following address:

When exercising the right to cancel a purchase during the cooling off period, SNAP is required to reimburse the amounts paid by the customer at no charge, except for return postage. The refund must be made within 15 days.


6. Price

All prices are quoted in euros. 
The price listed on the product description does not include shipping. 
The price indicated in the order confirmation is the final price, including all taxes and VAT for France and EU countries. This price includes the price of products, handling, packaging and storage of goods, transport costs and commissioning.


7. Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by SNAP. 
The price of products is payable from the order date. 
Payment is made using a bank card with the CB logo. 
Online PAIEMENT enables you to pay using PAYPAL bank server in a secure environment. 
Your credit card number is directed to the bank's servers and your payment is made directly to a bank in a secure environment without going through the shop's server, which is a very important guarantee as it means that your number will only be known by our partner bank (PAYPAL).

The order confirmed by the customer will only be considered effective once the bank payment centres in question have given their approval. In the event of a refusal from the aforesaid centres, the orders will be automatically cancelled and the customer will be notified by email. Furthermore, SNAP reserves the right to decline any order from a customer with whom they are in dispute.


8. Disputes

This contract is subject to French law. SNAP cannot be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or improper use of products sold. The same applies for any modifications to products from product manufacturers other than SNAP. In any event, SNAP liability will be limited to the amount of the order and the company cannot be blamed for simple mistakes or omissions that may occur despite all precautions taken in presenting the products. In the event of any difficulties in applying this contract, the buyer can seek an amicable solution, before resorting to legal action, by means of a professional organisation for the industry, a consumer association or any other counsel they may choose. As a reminder, seeking an amicable solution does not interrupt the "short notice" of the legal guarantee, or the duration of the contractual guarantee. Generally speaking, and subject to the court's discretion, complying with the provisions of this contract in relation to contractual guarantees requires that the buyer honour his financial obligations towards the seller. 
Complaints or disagreements will always be given sympathetic consideration; the complainant, having made the effort to expose his situation, presumed to be of good faith. In case of dispute, the customer should first contact the company to find an amicable solution. 
Failing that, the Tribunal de Commerce d'Annecy has exclusive jurisdiction, regardless of the place of delivery and method of payment accepted.


9. Guarantee

SNAP cannot be held liable for non-compliance with current regulations or legal requirements in the receiving country; SNAP liability is always limited to the value of the product in question, its value at the time of sale and with no possibility of appeal to the brand or company that manufactured the product. 
In any event, the customer benefits from the legal guarantee on eviction and hidden defects (Art. 1625 and following of the Civil Code). On the condition that the buyer provides proof of the hidden defect, the seller must legally repair all the consequences (1641 and following of the Civil Code); if the buyer goes to court, they must do so at "short notice" after the discovery of the hidden defect (article 1648 of the Civil Code). 10. Legal notices

Personal information collected for distance selling is a requirement as this information is essential for processing and delivering the orders, preparing invoices and guarantee contracts. Failure to provide information leads to invalidation of the order. In accordance with the French Data Protection Act, processing personal information about customers has been the subject of a declaration by the Commission Nationale de L'Informatique et des Libertés (the French National Commission on Information Technology and Liberties). The customer has a right (article 34 of the law of 6th January 1978) to access, modify, rectify and delete data that concerns him, and he may exercise this right with SNAP. Furthermore, SNAP undertakes not to provide customer information to third parties free of charge or against compensation.
